Norfolk Southern suing Highway Materials following train derailment in Whitemarsh Township due to a sinkhole

The Norfolk Railroad Company filed a complaint on July 16th in the United States District Court for the Eastern District of Pennsylvania, claiming that the property owner of the quarry adjacent to the tracks, Highway Materials, is responsible for a sinkhole that caused a train derailment in Whitemarsh Township on July 17, 2023.

In the complaint, Norfolk Southern details a series of sinkholes along the tracks that it has repaired between July 2023 and the filing of the complaint at a cost of $2,110,915.27. The rail company claims the sinkholes have “occurred within the zone of influence under the permit issued for the Quarry and was the responsibility of the Quarry owner” and that the owner has denied responsibility.

Norfolk Southern is seeking the cost of the repairs, along with interest, attorney fees, etc.
