Conshohocken’s Borough Council wins appeal of Zoning Hearing Board decision to invalidate ordinance that would allow a Wawa

On January 17th, Judge Wendy Rothstein of the Court of Common Pleas of Montgomery County sided with Conshohocken’s Borough Council and reversed the decision of Conshohocken’s Zoning Hearing Board to invalidate the ordinance that would allow a Wawa at the Moore property in Conshohocken (1100 block of Fayette Street).

Borough Council voted 4-3 to pass the ordinance in November of 2017. That decision was appealed by neighboring property owners to the Zoning Hearing Board. In January of 2019, the Zoning Hearing Board by a vote of 3-2 invalidated the ordinance. Borough Council then appealed that decision to the Montgomery County Court of Common Pleas and the below order is the end result of that process.

We will reach out to the various parties for comment, especially those opposing the Wawa to see if they plan to appeal this latest decision.
