Developer Appeals Zoning Board Decision on Convenience Store and Gas Pumps

Provco Pineville, the developer whose plan to build a convenience store with gas pumps at 12th and Fayette was denied by Conshohocken’s Zoning Hearing Board in August, filed an appeal to the decision in the Court of Common Pleas of Montgomery County on September 7th.

The appeal recaps the process for approval and what zoning relief was sought. It then goes on to describe the decision as “arbitrary, capricious, an abuse of discretion and contrary to the law.” It follows that up by calling the decision “vague, ambiguous, irrational and without legal authority.”
