As MoreThanTheCurve.com reported previously, Millennium Waterfront Associates II, LP, which is associated with Brian O’Neill, appealed a determination made by the Borough of Conshohocken that residential uses are not permitted within the SP-2 zoning district along Conshohocken’s riverfront south of the Matsonford Bridge. The appeal was before the borough’s hearing board and concluded on May 15th.
The developer sought to build an apartment community on a parcel between 20 Ash Street and 225 Washington Street that is currently utilized as a parking lot. The apartment building would be four stories and consist of 79 units.
The appeal involved how language within the zoning code, along with other documents, are to be interrupted. The developer believes that residential uses were not removed from the SP-2 zoning code in 2013. The borough’s attorney argued that residential uses were removed.
The members of the zoning hearing board voted 5-0 to deny the appeal. The developer now has the opportunity to appeal the decision within the court system. The developer has 30 days after the zoning hearing board renders its formal decision (on paper).
